GENERAL CONDITIONS OF SALE
1.1 THE PARTIES:
For the purposes of this contract we mean: SELLER HappyTec di Walter Del Medico, with headquarters in Via Pisino, 159 – 00177 Rome (RM) – CUSTOMER the person who purchases goods and services for sale on this site.
1.2 OBJECT OF THE CONTRACT:
It is the remote buying and selling of goods and services published on the pages of the site http://shop.happytec.it, according to the methods and conditions reported below.
Walter Del Medico's HappyTec reserves the right to modify the description of the goods themselves, as well as the conditions of sale published on this site, without prejudice to the validity of contracts already regularly concluded before the modification.
1.3 PURCHASE CONDITIONS:
The online purchase procedure immediately generates the activation of a purchase proposal by the user.
Walter Del Medico's HappyTec will automatically send via e-mail confirmation of receipt of the aforementioned proposal and the information documentation required by the art. 4 of Legislative Decree 22.05.1999 nr. 185 implementing Directive 97/7/EC, relating to consumer protection regarding distance contracts.
Following verification of the availability of the requested goods and payment of the corresponding amount according to the established methods, HappyTec di Walter Del Medico will automatically convert the purchase proposal into an actual order, communicating this to the user via e-mail and via the personal area within the site.
From this point Walter Del Medico's HappyTec will process the order in the necessary time.
2.0 PAYMENT METHODS:
You can decide to pay for your purchases on shop.happytec.it in one of the following ways:
2.1 CREDIT CARD THROUGH STRIPE CIRCUIT
When you decide to pay by credit card, you will be automatically redirected to a secure page on the Stripe gateway to complete the payment.
If you choose to process the payment by credit card through the PayPal circuit, it will be sufficient to enter the requested information even if you do not have a PayPal account.
If you use the Stripe payment gateway, simply enter the required information and the payment will be processed.
Your credit card data will be treated with the utmost confidentiality and guarantee as the information is transmitted directly to the bank and not even Walter Del Medico's HappyTec can become aware of such information.
In case of cancellation of the order or non-acceptance by HappyTec di Walter Del Medico, the amount will be refunded to your credit card.
You can check if you are operating in safe mode in the following ways:
1. By receiving a warning from your browsing program;
2. Verifying that the address of the page you are operating on is preceded by the abbreviation HTTPS;
3. Checking that in the lower right or left part of the window of your navigation program, there is a closed padlock or a whole key (SSL3 system active).
Attention:
It may happen that during the credit card payment process, the service returns an error and may not complete the transaction.
In this case, we will contact the Customer if we encounter problems with the payment.
2.2 PAYPAL
By selecting the PayPal payment type, you will be redirected to a page on the PayPal website where you will enter your e-mail address and password and make the payment.
Your financial data will be managed directly by PayPal; Walter Del Medico's HappyTec will not collect any sensitive information during the payment transaction.
In case of cancellation of the order or non-acceptance by HappyTec di Walter Del Medico, the amount will be refunded to your PayPal account.
2.3 BANK TRANSFER
By accepting the conditions of sale and requesting payment via BANK TRANSFER, the buyer undertakes to make the payment no later than 5 working days, under penalty of cancellation of the order.
The shipment of the material will be invoiced when the bank transfer is actually credited to our current account.
ATTENTION:
We remind all Customers that test orders placed for any reason other than purchase are not permitted.
Orders are not canceled automatically therefore, in the event that you are unable to make payment within the established 5 days, please kindly notify HappyTec di Walter Del Medico by e-mail to the address [email protected] indicating the details of the order.

2.4 CASH
For payments made directly when collecting the goods at the HappyTec headquarters of Walter Del Medico, in Via Pisino, 159 – 00177 Rome (RM), only cash payment is accepted.
3.0 SHIPPING AND DELIVERY TIMES
For national and international deliveries, shipments are made via express courier.
Delivery times are on average 1-5 working days and vary depending on the payment method chosen and the destination of the goods (for foreign countries it may take more days).
SHIPPING TO ITALY ACCESSORIES AND SMALL PARCELAGES
Fixed cost for single shipment to ITALY: €6,90 (free for orders equal to or greater than €50,00).
Single shipping cost FOREIGN: starting from €15,00
Shipping cost for bulky items: €25,00
The actual calculation of the shipping cost will take place at the time of payment.

Order processing times:
Our management of warehouse logistics allows us to guarantee customers that all orders placed by 11.00 am on working days (from Monday to Friday, unless otherwise indicated in the times indicated in the advertisement) will be processed and entrusted to the couriers on the same day .
Actual delivery times vary based on courier availability.
TRACKING REQUEST:
Exclusively via email, telephone or WhatsApp.
The courier will send an email when they receive the package and will notify the customer of the progress of the shipment.
Shipping costs include handling and packaging charges and courier costs.
Management costs are always at our expense, while transport costs are at your expense where indicated in the cart.
We advise you to group your items in a single order.
It is not possible for us to group two distinct orders placed separately, therefore shipping costs will be charged for each of them.
The boxes are adequately large in size and your items are well protected.
PLEASE NOTE:

– we are not responsible for any delays and/or failed deliveries caused by incomplete addresses.

4.0 SHIPPING COSTS:
Shipping costs are automatically displayed in your order summary before the checkout process.
For all purchases made, shipping costs are free for orders over €50,00 (excluding foreign countries).

5.0 GUARANTEES:
Our guarantee ends with the replacement of those parts which, returned only after our authorization free from our premises, are recognized by us as defective due to causes resulting from unsuitable workmanship.
We decline all responsibility for any accident that may occur due to and/or during the use of the products supplied by us, and cannot give rise to a request for reimbursement or compensation.
Any problems relating to correspondence or the completeness of the products received must be reported within 7 days of delivery to [email protected] according to the methods provided in this document.
In the event that HappyTec di Walter Del Medico makes an error and the customer receives material different from the one ordered, it will be replaced and the shipping costs for returning and sending it will be borne by HappyTec di Walter Del Medico.
If the customer receives incorrect material due to an ordering error, the material will be replaced, the shipping costs for returning and sending will be borne by the customer
6.0 LEGAL COMPETENCE
The law in force and applicable for purchases on the site http://shop.happytec.it is that of the Italian Republic.
For any dispute relating to the sale of goods and services within the site, the competent court is that of the Court of Rome.
7.0 RIGHT OF WITHDRAWAL
The right of withdrawal is regulated by law if the customer-consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase by indicating a VAT number in the order form ) has the right to withdraw from the purchase contract for any reason.
To exercise this right, the customer must send HappyTec di Walter Del Medico a communication within 14 working days from the date of delivery of the goods. This communication must be sent by REGISTERED MAIL with return receipt addressed to HappyTec di Walter Del Medico, Via Pisino, 159 – 00177 – Rome (RM).

Please note: Customers who purchase with a VAT number cannot exercise the right of withdrawal.
The right of withdrawal is however subject to the following conditions (Article 67 of the Consumer Code) if the goods have been delivered, the consumer is required to return them or make them available to the professional or the person designated by them, according to the methods and times provided for in the contract. The deadline for returning the goods cannot in any case be less than ten working days starting from the date of receipt of the goods.
For the purposes of expiry of the term, the goods are considered returned when they are delivered to the accepting post office or to the forwarder.
For contracts concerning the sale of goods, if the goods have been delivered, the substantial integrity of the goods to be returned is an essential condition for exercising the right of withdrawal.
However, it is sufficient that the goods are returned in a normal state of conservation, as they have been kept and possibly used with the use of normal diligence.
The costs payable by the consumer for exercising the right of withdrawal pursuant to this article are the direct costs of returning the goods to the sender.
If the right of withdrawal is exercised by the consumer in accordance with the provisions of this section, the professional is required to reimburse the sums paid by the consumer, including the sums paid as a deposit.
The refund must be made free of charge, in the shortest time possible and in any case within thirty days from the date on which the professional became aware of the consumer's exercise of the right of withdrawal.
The sums are considered refunded within the terms if they are actually returned, shipped or re-credited with a value no later than the expiry of the previously indicated term.
In the event that the payment was made by means of bills of exchange, if these have not yet been presented for collection, they must be returned.
Any clause that provides for limitations on the reimbursement to the consumer of the sums paid as a result of the exercise of the right of withdrawal is void.
If the price of a good or service, the subject of a contract referred to in this title, is entirely or partially covered by a credit granted to the consumer, by the professional or by third parties on the basis of an agreement between them and the professional, the credit contract is considered automatically terminated, without any penalty, in the event that the consumer exercises the right of withdrawal in accordance with the provisions of this article.
The professional is obliged to communicate to the third party granting the credit the exercise of the right of withdrawal by the consumer.
Any sums paid by the third party who granted the credit to pay for the goods or services up to the moment in which they are aware of the exercise of the right of withdrawal by the consumer are reimbursed to the third party by the professional, without any penalty, without prejudice the payment of accrued legal interest.
Return of goods:
The product must be sent to HappyTec di Walter Del Medico, Via Pisino, 159 – 00177 – Rome (RM) within 14 working days.
Without prejudice to any restoration costs for confirmed damage to the original packaging, HappyTec di Walter Del Medico will reimburse the customer the entire amount already paid for the product, within 10 working days of the return of the goods, via a refund procedure. on the payment method used at the time of the order.
It will be the customer's responsibility to promptly provide the bank details on which to obtain the refund (IBAN code of the invoice holder).
When the right of withdrawal expires (Article 55 of the Consumer Code) The right of withdrawal provided for in articles 64 et seq., as well as articles 52 and 53 and paragraph 1 of article 54 do not apply:
a) to contracts for the supply of foodstuffs, drinks or other goods for domestic use for daily consumption supplied to the consumer's home, place of residence or place of work by distributors who make frequent and regular rounds;
b) to contracts for the supply of services relating to accommodation, transport, catering and leisure, when upon conclusion of the contract the professional undertakes to provide these services on a specific date or in a pre-established period.
Unless otherwise agreed between the parties, the consumer cannot exercise the right of withdrawal provided for in articles 64 and following in the cases:
a) the supply of services whose execution began, with the agreement of the consumer, before the expiry of the deadline set by article 64, paragraph 1;
b) the supply of goods or services whose price is linked to fluctuations in financial market rates that the professional is not able to control;
c) the supply of goods made to measure or clearly personalized or which, by their nature, cannot be returned or risk deteriorating or expiring rapidly;
d) the supply of sealed audiovisual products or computer software opened by the consumer;
e) supply of newspapers, periodicals and magazines;
f) betting and lottery services.

HappyTec reserves the right to independently and without the need for communication to the Customer, send a request for feedback exclusively on orders placed.
